  1. The Da Afghanistan Bank (DAB), Islamic Republic of Afghanistan intends to avail the services of competent consultants for the mentioned services and use own fund towards payment for the consultancy for which this Request for Expression of Interest (REOI) is being issued.

 

  1. LOT A: Developing database for Banking & non-Banking sections of AML/CFT

 

  1. SCOPE of LOT A of Assignment

 

Under the SCOPE of the assignment for Lot A, the Consultant will conduct collection of data per given tools and generation of Risk Matrix of target banks and non-banking institutions to retain, process, evaluate and analyze the data, and further evaluate and analyze the different types of the ML/TF and severity of those risk that bank/institution is susceptible to.

 

The Scope of this assignment shall include:

  1. Thorough analysis of given tools for its efficacy;
  2. Thorough analysis of the AML/CFT database;
  3. Detailed report on the applicability and reliability of these databases;
  4. Detailed functional requirements of these databases and necessary revisions;
  5. Creation of online and user-based Database;
  6. Database should have all requirements of the above mentioned AML/CFT tools;
  7. The transfer of data from questionnaire and data collection to risk matrix should be automated and the final result/outcome should be generated;
  8. The risk matrix incorporated in the database should have the ability to assess/analyze the given data and generate results;
  9. Analysis or results generated by the risk matrix must be retained and saved separately for each banks;
  10. The banks should only have access to Questionnaire and data collection;
  11. The database should have an Reject and Receive option and only the AML/CFT unit of Da Afghanistan Bank can have access to it not the reporting entity/bank
  12. The reporting entity should only have the option to submit the required data/information;
  13. The database should have the option to be edited, updated and deleted;
  14. The database should have the facility to retrieve the data and the final results; and
  15. The database developed should be customizable ( the database should have the ability to be changed or adjusted based on the needs or requirements of laws and regulations)

 

  1. Project Development Objective of LOT A of the Assignment: 

 

The Objective of the assignment is to undertake a study and design two separate databases for banking and non banking section of AML/CFT unit of Financial Supervision Department through which it can gather data from the bank and non banking institutions to analyze, process and retain the data for the future uses.

 

The database designed for the banks should have the following capabilities and functionalities:

 

Banking Institutions:

  • Gathering qualitative and quantitative data from the financial institutions;
  • Provision to accept and reject the data sent by the financial institutions; with simultaneous alert of the action to the financial institution/s.
  • Provision of the options to transfer the data from questionnaire and data collection to risk matrix.

 

   Non-banking institutions:

  • Recording and retaining all the enforcement actions imposed on all non- banking institutions;
  • Recording all the transactions (transfers to abroad and inside Afghanistan)

 

Formatting & Operational Flexibility:

  • The provision of option and flexibility to select data, transfer selective data, and improvise additional benchmarks in the databases and Risk Matrix. 

 

  1. The Deliverable of LOT A of Assignment:

           

Generation of two separate databases for banking and non banking section of AML/CFT unit of Financial Supervision Department/DAB, capable of collecting data from the bank and non-banking institutions to analyze, process and retain the data for the future uses, in order to facilitate:

Banking Institutions:

  • Collecting qualitative and quantitative data from the financial institutions;
  • Screening, acceptance and rejection of data received from the financial institutions;
  • Capability to transfer the collected data to risk matrix.

 

   Non-banking institutions:

  • Recording and retaining all the enforcement actions imposed on all non- banking institutions;
  • Recording all the transactions (transfers to abroad and inside Afghanistan)

  

  1. LOT B:  Developinf Database for Licensing Unit of Financial Supervision Department

           

  1. SCOPE of the LOT B of the Assignment

 

          Generation of comprehensive database capable of recording  information, uploading the scanned documents, retaining the information and documents, having the option to update and edit the information and documents, ability of giving alerts to certain criteria, generating reports and having the ability to be customized.

 

  1. Project Development Objective of the LOT B

 

The objective is to have a standard and comprehensive database with following capabilities and functionalities:

  1. Recording  information;
  2. Uploading the scanned documents;
  3. Retaining the information and documents;
  4. Option to update and edit the information and documents;
  5. Facility of raising alerts to certain criteria;
  6. Generating reports;
  7. The ability to be customized;

According to the tasks, the information/data which need be recorded, uploaded, retained, edited and updated, and reports generated from the database are as following:

 

 

  • Complete Reputation: name, last name, date of birth, place of birth, gender, nationality, identity card (Tazkira) number, passport number (in case of foreigners), telephone number, email address, signature sample, present address, previous address;
  • Academic background: degree of education (bachelor, post graduate, PHD), field of study, university name;
  • Experience: years of experience, area of experience;
  • Financial ability: financial statement, Net worth, source of fund, characteristics of Real Estate Property;
  • Characteristics of businesses and investments: name of businesses or investments, type of business, percentage of shares and voting right, location of businesses or investments;

Legal person owner:

  • Characteristics of companies or institutions: name, license no, establishment date, type of company, location and tax number (TIN);
  • Characteristics of subsidiaries and parent company;
  • Financial ability: financial statement, Net worth, source of fund, characteristics of Real Estate Property;
  • Characteristics of beneficiary owners: the same as above mentioned information for real person owners;
  • Information of Key responsible officials: the same as above mentioned information for real person owners;
  • Information regarding subsidiaries, associated enterprise and investments:

      - The name of the business and organization;

      - The type and location of the business; and

      - The percentage of shares and voting right in the relevant business.

   

Banks’ key officials:

  • Supervisory Board: Number, complete identification of its each member including (Name, Surname, Date of Birth, Place of Birth, Gender, Nationality, ID/Tazkira Number, Passport Number/ if the person is foreigner, Telephone Number, Email Address, Signature Specimen, Current and Previous Address, Working and Educational Background, Employment and Resignation Date, The Type of Employment (6months/4 years), Warning and other type of Enforcement Actions if already imposed, The Amount of Evaluation fee and the Account Number to which such amount  is being transferred and information regarding performance appraisal), and official leave related information.
  • Audit Committee: The information as mentioned above for BOS.
  • Management Board: The information as mentioned above for BOS.

Application for key vacant positions:

  • Bank name, the candidate name, proposed position, application date, educational degree, result of CV screening( may be accepted or rejected with its date), interview date, result of interview (may be approved or rejected with its date), type of approval (may be for 6 months or four years), approval letter date, application fee,

Banks' Facilities:

  • Full Service Branch (Type 11): Number, Full Address, Application Date,, Approval Date, Status (Operational/ Non-operational), Operational Date, The Amount of Application Fee, Information of Branch Manger including (Name, Surname, Telephone Number, Email Address and Educational Degree), Relocation Date and Place The closure Date, and The Closure and Operational Date if an operational branch is to be closed temporarily for not more than six month.
  • Limited Service Branch (Type12): The required information for this type of facility is the same as for the full service branch.
  • Type (21) Facility: The required information for this type of facility is the same as for the full service branch.
  • Type (24) Facility: Number, Full Address, Application Date, Approval Date, Status (Operational/ Non-operational), Operational Date, The Amount of Application Fee, Information of Responsible Person including (Name, Surname, Telephone Number, Email Address and Educational Degree), Relocation Date and Place The closure Date, and The Closure and Operational Date if an operational branch is to be closed temporarily for not more than six month.
  • Type (25) Facility: Number, Full Address, Application Date, Approval Date, Status (Operational/ Non-operational), Operational Date, The Amount of Application Fee, Information of Branch Manger including (Name, Surname, Telephone Number, Email Address and Educational Degree), Relocation Date and Place, the closure Date, and the Closure and Operational Date if an operational branch is to be closed temporarily for not more than six month.
  • Type (22) Facility/ATM: Number, Full Address, Application Date, , Approval Date, Status (Operational/Non-operational), Operational Date, Information responsible person including (Name, Surname, Telephone Number, Email Address), Relocation Date and Place,  the Inactivity Date, and also the Inactivity and  Operational Date if an operational ATM is inactivated temporarily for not more than six month.
  • Type (23) Facility/POS: the required information for this type of facility will be the same as for the ATM machine.

Conversion of facilities:

All the above stated facilities may be converted among each other from time to time by the bank. So the below feature is also deemed appropriate to be added in the data base:

  • Conversion: The previous type of the converted facility, the current type, the amount of fee for conversion application.

      It should be noted that the information regarding each facility after its conversion should be the same as specified for the relevant type in the data base.

 

Electronic Cards:

  • Type of Cards: Including Debit Cards, Credit Cards, ATM Cards, Prepaid Cards, Web surfer Cards, Gift Cards.
  • Number of Cards.
  • The number of cards in province and bank wise.

Banks Capital:

  • The details of shareholding structure of the bank and the changes in the shareholding of the bank from time to time, including (Amount of Capital, Percentage and Number of Shares, Date of Shares Transferred to an acquirer, The Percentage Shares Transferred to an acquirer) and the details regarding the acquirer as per information needed for a shareholder of the bank.
  • Details of Capital injections: Amount, Date and Source of injection, the name of shareholder by which such injection is done, and in case of real state the specifications of deed after and before of the change of its ownership in the name of bank, the Force and Market Value of the property, the name and specifications of the property evaluator including (Name, Location, Phone Number and Email Address), the date on which the bank has gone undercapitalization and the date of plan provided for capital injection.

 

Penalties:

  • Penalties imposed on vacant key positions and on contravention in establishment norms, relocation and conversion of bank facilities and other issues need to be penalized.

Electronic Money Institutions:

The required information for these institutions is the same as for the banks.

 

Payment system operators:

The required information for these operators is the same as for the banks.

 

Money service providers:

  • Issuance of new license: Application date, complete identification of the owner including (name, father’s name, Tazkira/passport number, telephone number, email address, previous and current location, photo and signature specimen),
  • TIN number, bank accounts number and name with related banks’ name,
  • Fees and cash guarantee information such as type and amount of fee, related account number that the fee is transferred,
  • Identification of official staff in the head office (as per information which is stated for MSPs’ owner),
  • MSP’s Branches: number of branches, location, identifications of branches’ official representatives( as mentioned above), fees and monetary guarantee information, branches’ TIN number,
  • Identifications of two guarantors: name, father’s name, tazkira and license number, trade name, validity date of license,
  • Specification of the license which is being issued: license number, trade name, issuance date, validity date, business location (province, district, market, shop number and related MSP/FXD association),

Renewal of MSP license:

  • Application-date,  processing fees, renewal-date and validity-date of renewed license,
  • Changes in branch/head office location, number of branch, ownership (date of application, processing fee, approval date, date of public notice, identification of new owner)  and information regarding burning and loss of license if any,
  • Enforcement actions imposed on the MSP: warning (reason and date), dismissal of official representatives and staff, monetary penalty (date, reason and amount).

Quit of MSP:

  • Application date, approval date, reason, processing fee, amount of transferred cash guarantee, detail of account in which the cash guarantee will be transferred.

Revocation of MSP:

  • Reason, date, specification of cash guarantee which is transferred to DAB revenue account.

 

Foreign Exchange Dealers:

The required information for FXDs is the same as for MSPs.

 

MSP and FXD firm:                                       

The required information regarding share holders, board of supervisors and management board is the same as for banks and other required information regarding such application will be as for individual MSPs.

 

External Audit companies:

  • application date, processing fee information, specifications of license from Ministry of commerce and industries (license number, trade name, issuance and validity date), address, list of services,
  • identification of shareholders: as stated for banks’ shareholders,
  • experience information: years of experience, information regarding audited companies by applicant,
  • information  regarding parent company (if any): name, location, list of technical support by parent company,
  • annual fee information
  • information regarding professional auditors and management board members: as required for management board of bans in the database,
  • Changes in shareholders, management board and auditors.

 

Source code:

The source code of the database shall remain the property of Da Afghanistan bank.

 

Leasing Companies:

The required information regarding such companies will be the same as for banks.

 

Deposit Taking Micro Finance Institution:

The required information regarding such companies will be the same as for banks.

 

  1. Deliverable of the LOT B

The Deliverables for this LOT of assignment include:

The developed database should provide the following features:

  • Online and accessible to all licensing staffs both in headquarter and related zones;
  • Advanced security features;
  • Generating red flags/pop-up messages;
  • Search functions,  support text writing, and generating various reports;
  • Facility for adding and expanding the database to add/amend more fields of data and facility to be customized;

 

 

  1. The Da Afghanistan Bank now invites qualified, competent and eligible firms, having enough experience in Data and Database Management and possessing the required necessary expertise and relevant certification, to express their interest   in providing the services for both LOT A & B above. Interested firms must provide information indicating that they are qualified to perform the above mentioned services.

 

  • The consultant shall demonstrate having sound financial situation and capacity in the past three years (should not have incurred losses ) by submitting latest financial audit report with an annual turnover of at least 3,000,000AFN for any of the last 3 (three) years;
  • The consultant should have been in business since at least last 5 (five) years;
  • The consultant shall also provide proven experiences of having executed at least one contract of similar nature, with the value of minimum 2,000,000AFN.

 

  1.  Consultants may associate with other firms (local) to boost their capacity   and enhance the value and quality of their services. If consultants intend to associate with        other firms, they should clearly state in their EOI the composition and form of the association and identify the lead Consultant. 

 

  1. Consultants will be short listed in accordance with Quality and Cost Based Selection        (QCBS) procedures set out in the public procurement law and Rules of procedures. Interested consultants may obtain further information and collect the Terms of Reference at the address below from 8 am to 3:30 pm local time, Saturday to Wednesday.

 

  1. Expression of interest (EOI) must be delivered on or before the 14.00 hours Kabul local    time 18 March 2019 at the address given below. The EOI submissions shall be made as:    “Original” plus two “Copies” including a soft copy on CD. Consultants may, optionally,          submit their EOI by email. If an EOI is submitted by email the consultant must ensure           that it   is the complete and signed copy that is being attached. An EOI that is not signed will not   be accepted.
